This Privacy Policy (this “Policy”) describes how Plata Financial, Inc. (“we,” “us,” “our,” or “Plata”) collects, uses, and discloses information about the businesses and individuals who use our payroll, time tracking, attendance management, and money transfer platform (our “Platform”).
This Policy explains the types of information that we collect about individuals who set up and operate business accounts (“Administrators”) on behalf of businesses managing their payroll, time tracking, attendance, or any combination thereof, through our Platform (“Businesses”), as well as individuals who receive payroll, track their time, record their attendance, transfer money, or any combination thereof, through our Platform (“Members” and, together with Businesses and Administrators, “Users,” “you,” or “your”).
This Policy applies to all information provided, transmitted, or submitted to Plata in connection with the payroll, time tracking, attendance management, money transfer, and other related services we provide (collectively, our “Services”), including on this website and any related website or mobile application (our “Site”). By using our Site, you agree to the collection, use, and disclosure of your information as outlined in this Policy.
1. What this Policy covers
This Policy applies to the information we collect and process when you:
visit, interact with, use, or apply to use any Services or Sites that link to this Policy;
communicate with us, including via email, phone, or mail;
create or administer your Plata account;
verify your identity;
complete a questionnaire, support ticket, or other information request form;
engage in a contracting process with Plata;
register or take part in our marketing, learning, or training events; or
otherwise interact with Plata, our Platform, our Services, or our Site
2. Information we collect and how we collect it
When you access our Site or use our Services, we collect and store certain information about you from a variety of sources. This information includes Personally Identifiable Information (“PII”), information that, alone or when combined, can be used to personally identify you. Plata only collects or requests access to PII and other information relevant to the core functionality of our Services, or as required by law, and we do not use, transmit, or share your personal data without first obtaining your permission. We collect the following categories of PII and other information as described below.
A. Information we collect about Members
In order to provide our Platform and Services, we collect and process certain information about our Members. This information is either shared with us directly by Members or shared on behalf of Members by Administrators, including:
Contact information, such as name, address, phone number, email.
Account information, such as username, password, security questions.
Identification information, such as government-issued identification, social security number, taxpayer identification number.
Financial information, such as bank account and routing numbers, bank account balance and transaction information, credit check information.
Demographic information, such as date of birth, gender, veteran status, race and ethnicity, citizenship status.
Employment information, such as your title, role, photo, salary, historical payment information, and hours worked.
Geolocational information, such as location at the time of “clock in” and “clock out,” only when directly related to our Services.
Other information that you voluntarily choose to provide.
We collect and process Member information for the purpose of providing our Platform and Services, and we process such data as instructed by our Employers as their “data processor” or “service provider,” as defined under applicable laws. The Employer, and not us, is the “data controller” or “business,” as defined under applicable laws, of your information.
B. Information we collect about Administrators
In addition to collecting information about Members, we also collect and processes certain information about Administrators. This information is shared with us directly by Administrators, including:
Contact information, such as name, business address, phone number, email.
Work-related information, such as title, role, photo.
Company-related information, such as Services purchased, tax information, insurance policies and claims, number of employees, ownership structure, business metrics.
Company-related payment information, such as bank account and routing numbers, credit or debit card information, bank account balance and transaction information.
Other information that you voluntarily choose to provide.
C. Information we collect automatically
As you engage with our Platform, we also automatically collect certain information about your interactions with us (“Usage Data”). To do this, we may use cookies, web beacons/clear gifs, and similar online technologies. Usage Data may include:
Device information, such as mobile carrier, device IDs, mobile advertising IDs.
Browser information, such as operating system, browser type, IP address.
Financial information, such as payroll amount and frequency, money transfer amount, frequency, and destination, and bank account information.
Location information, such as approximate location derived from IP address, only when directly relevant to our Services.
Tracking technologies, such as cookies and pixel tags.
Internet activity information, such as your log information, the pages you visit before, after, and while using our Services, and the pages you visit, links you click, and content you view while on our Site.

3. How we use your information
Plata uses information about you only as required to accomplish a relevant task, as directed by you. We use the information we collect about you for the following purposes:
To provide our Platform, including to operate our Site, provide customer service, develop new products and features, and maintain, manage, or service account.
To operate our business, including to provide our Services, collect payment, maintain accounts, manage and enforce contracts, and generate anonymized or aggregated data.
To communicate with you, including to respond to customer service requests, send surveys and receive feedback, and contact you with Service-related information.
To advertise and market to you, including to analyze your use of our Platform, send you marketing communications about third-party bank accounts and other financial products and services, and determine your eligibility for various programs and offers.
To protect Plata and our users, including to secure your account and our Platform, detect and prevent fraud, and prevent or stop illegal, unethical, or legally actionable activity.
To comply with legal obligations, including to address disputes, respond to claims and legal processes, and monitor and enforce compliance with our Terms.
Other purposes for which you or your employer expressly authorize us to use your information.
4. How we disclose information we collect
We may disclose your information within Plata, to our affiliates, and to third parties with whom we have a written contract limiting the use and disclosure of your information as directed by you to provide the services or products you request, or as permitted by law, and ensuring that such entity or entities will provide, at a minimum, the same or equal protection of your information as we do. For example:
Plata and our affiliates. We may provide your information to companies related to us by common ownership or control. These companies may use this information to support our Services you request or market additional products and services to you.
Others within your organization. If you are an Administrator, we may disclose your information to others in your organization in accordance with your account settings and preferences. If you are a Member, we may disclose certain information about your use of our Services to your associated Business and its Administrator(s).
Business partners. We work with business partners to offer joint products and services. We may share information with these business partners, pursuant to written contracts that require them to safeguard your information and prevent them from using your information for any purpose other than those specified in the contract.
Service providers. We may share your information with third-party service providers and vendors who perform certain functions on our behalf. For example, we use service providers to provide money transfer, banking, payment processing, data analytics, identity verification, cloud storage, IT, email storage, and security services.
Advertising services. We provide advertising companies with certain information, such identifiers such as your name and email address, your network activity, and a record of transactions that you conduct on our Platform, to allow them to deliver advertising tailored to your interests when you visit certain other websites.
Fundamental corporate transactions. If we sell our business or transfer any of our assets, including through bankruptcy, certain information about Businesses, Administrators, and Members may be a part of that sale or transfer. We will notify you if such a transaction results in a material change to this Policy.
Legal matters. We may share your information when we have a good faith belief that such disclosure is required or permitted by law or pursuant to a legal request. For example, we may share your information with a government agency to comply with reporting requirements, or with a court in response to a legal claim.
Aggregate data. We may share aggregate data from information that does not personally identify you. This may include, for example, the number of visitors from a certain geographic area and the average age of users of our Services.
With your consent. We may disclose your information to third parties when we have your consent, or your employer’s, express consent to do so.
5. Third-party services
This Policy does not apply to products or services offered by third parties on or through our Site or to products or services offered by third-party websites, each of which have their own terms and privacy policies. While we endeavor to work with third parties that share our respect for user privacy, we are not responsible for their privacy practices. So, if you follow a Third-Party Link or use an Integrated Service (each as defined below), make sure to carefully review the third party’s privacy policy and any applicable terms and conditions to inform yourself of their practices before you provide them with your information.
A. Third-party links
We may provide links within our Site that navigate away from our Site to third-party websites, products, and services (each such link a “Third-Party Link” and each such third party, a “Third-Party Provider”). If you leave our Site by following a Third-Party Link, please be aware that the collection, use, and disclosure of your information by the Third-Party Provider will be subject to the privacy policies of such Third-Party Provider, not this Policy.
B. Third-party integrations
Some of our services, including our Money Transfer Services (as defined in Section 7 of our Terms of Service), are provided by embedding a third-party service or product within our Site (each such product or service, an “Integrated Service” and each such third-party, an “Integrated Service Provider”). If you are using an Integrated Service, please be aware that the collection, use, and disclosure of your information by the Integrated Service Provider will be subject to the privacy policies of such Integrated Service Provider, not this Policy.
C. Disclosing information
When you request products or services from a third party, whether through a Third-Party Link or an Integrated Service, you give us permission to provide such third party with information about you necessary to fulfill or process your request. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of our Site and Platform and users of those third-party platforms without limitation as to its use by us or by a third party.

6. Children’s privacy
Children under the age of 16 are not permitted to use our Platform, and we do not seek or knowingly collect any information about children under 16 years of age. If we become aware that we have unknowingly collected information about a child under 16 years of age, we will make reasonable efforts to delete such information. If you are the parent or guardian of a child under 13 years of age who has provided us with their information, you may contact us as described under the “How to Contact Us” section of this Policy to request that it be deleted.

8. International users
Plata operates globally and may transfer, store, or process your information in locations around the world for the purposes described in this Policy. Wherever we transfer your information to a different country, we take reasonable steps designed to ensure that the information we collect is processed as described in this Policy and according to any applicable laws. As a result, your information may be subject to the laws of foreign jurisdictions, including laws that permit or require the disclosure of information to law enforcement or national security authorities upon request. By providing us with your information, you acknowledge any such international transfer, storage, or processing.
9. Data security and retention
We maintain a variety of physical, administrative, and technical measures designed to protect your information from unauthorized access and to comply with applicable privacy laws in the states and countries in which we operate. We have also implemented controls which require our third-party providers and partners to have appropriate safeguards to protect your information.
However, please be aware that, despite our efforts, no security measures are perfect, and no method of data transmission can be guaranteed to prevent any interception or other type of misuse. We also depend on you to protect your information. If you become aware of any breach of security or privacy, please notify us immediately. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.
We retain your information for as long as is reasonably necessary to fulfill the relevant purposes described in this Policy. When determining the length of time to retain your information, we consider various criteria, including whether we need the information to continue to provide our Platform, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property and products.
10. Sale of personal information
Plata does not sell personal or sensitive user data, including personally identifiable information, financial and payment information, contacts, authentication information, device location, SMS and call-related data, and other sensitive device or data usage. “Sale,” in this context, means the exchange or transfer of personal and sensitive user data to a third party in exchange for monetary consideration; user-initiated transfer of such user data is not regarded as a sale.
11. Your rights and choices
Depending on your location, you may have certain rights regarding your information. To exercise your rights, please contact us as described under the “How to Contact Us” section of this Policy. Subject to applicable law, you may have the right to:

We must verify your identity before responding to your request, and we may ask you to provide us with information we need to do so. We will consider all requests and provide our response within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing. We may deny certain requests, in whole or in part, as permitted or required by law. If we do so, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.
12. Changes or updates
Any information we collect is subject to the privacy policy in effect at the time of such collection. We may, however, periodically modify and revise our privacy policy. If we make any material changes to this Policy, we will notify you of such changes by posting them on our Site, informing you through our Platform, or sending you an email or other notification, and we will indicate when such changes become effective. By continuing to access or use our Site, Services, or Platform after those changes become effective, you agree to be bound by the revised policy.
